Birthright citizenship upheld, Trump loses in Supreme Court

International Desk Published: Wednesday, 01 July 2026 1 min read

Trump's executive order stated that if neither parent of a child is a US citizen or a lawful permanent resident, the child born in the United States would not receive birthright citizenship.

Chief Justice John Roberts said in the ruling that children born to parents living illegally or temporarily in the United States are also entitled to birthright US citizenship under the Constitution.

As a result of this court ruling, Trump's initiative to limit birthright citizenship is not currently in effect, and the policy of birthright citizenship recognized by the US Constitution remains intact.
