Caretaker government and referendum provisions restored in Appellate Division verdict
The Supreme Court's Appellate Division has upheld the High Court verdict on the Fifteenth Amendment to the Constitution. As a result, the caretaker government system and the provision for a referendum have been reinstated in the Constitution, according to concerned lawyers.

On Thursday (July 9), the full and regular bench of the Supreme Court's Appellate Division, led by the Chief Justice, announced this verdict.

Earlier, after three consecutive days of hearings on the appeal filed regarding the Fifteenth Amendment, the Appellate Division had set Thursday for delivering the verdict on Wednesday.

In the case, BNP Secretary General Mirza Fakhrul Islam Alamgir participated in the hearing as a party. Attorney General Ruhul Kuddus Kajol argued on behalf of the state. Additionally, lawyers Sharif Bhuiyan and Shishir Manir also took part in the court hearing.

On November 13 last year, the Appellate Division granted permission to appeal against the High Court verdict. The hearing of the appeal then began.

A total of three appeals were filed against the High Court verdict on the Fifteenth Amendment. Among them, four individuals, including Badiul Alam Majumdar, editor of Citizens for Good Governance (SUJON), filed one appeal. Mofazzal Hossain, a resident of Naogaon, filed another appeal. A separate appeal was filed by Bangladesh Jamaat-e-Islami Secretary General Mia Golam Parwar.

During the hearing, senior lawyer Sharif Bhuiyan and lawyer Karishma Jahan represented the four appellants, including the editor of SUJON. The state was represented by Attorney General Barrister Md. Ruhul Kuddus Kajol and Additional Attorney General Barrister Anik A R Haque. Senior lawyer Mohammad Shishir Manir represented the Jamaat Secretary General, and lawyer A S M Shahriar Kabir represented the other appellant during the hearing.
